Conditions of Use Wolfairy.com – Effective 21 June 2025
1. About These Terms
These Conditions of Use (“Terms”) set out the rules for using wolfairy.com (the “Site”) and govern every contract for the supply of goods between JMTI LTD (“we”, “us”, “our”) and you, the customer (“you”, “your”). By accessing the Site or placing an order you agree to be bound by these Terms, our Privacy Policy and any other documents expressly referred to. If you do not accept them, you must refrain from using the Site.
2. Who We Are
Trading name: Wolfairy
Legal entity: JMTI LTD (Company No. [insert])
Registered address: 47 Hyholmes, Peterborough PE3 8LJ, United Kingdom
Customer service & DPO e-mail: contact@jmti.co.uk
3. Eligibility & Account Security
You must be at least 18 years old and capable of entering into binding contracts. You are responsible for keeping your account credentials confidential and for all activities conducted under your login. Notify us immediately of any unauthorised use. We may suspend or terminate accounts where we reasonably suspect breach of these Terms or misuse of the Site.
4. Entire Agreement & Contract Formation
Made-to-order products. Most goods we supply are made to order or customised for you (e.g. garments sewn after purchase). We make this clear on the product page and in your Order Confirmation. Your order is an offer to purchase goods. A contract forms only when we dispatch the goods and send you a Dispatch Confirmation e-mail. We may refuse or cancel an order for legitimate reasons (e.g. stock unavailability, pricing error, failed security checks). The contract relates solely to goods detailed in the Dispatch Confirmation.
5. Prices & Payment
Prices are shown in pounds sterling (£) and include VAT at the prevailing rate unless stated otherwise. Delivery charges are displayed before checkout. We accept the payment methods shown on the Site. Payment is taken when your order is placed.
6. Delivery
Delivery times are estimates; time is not of the essence. Title and risk pass to you on delivery. If we miss an agreed delivery deadline for goods required for a set date, you may have remedies under the Consumer Rights Act 2015.
7. Cancellations & Returns (Consumer Contracts)
Statutory right to cancel – standard goods. You may cancel a distance contract for standard, non-customised goods within 14 days after the day on which you (or a nominee) receive them, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Exemption – made-to-order or customised goods. The statutory cancellation right does not apply to goods made to your specification or clearly personalised (Reg. 28(1)(b)). Such items are flagged before purchase. Your statutory rights if they are faulty remain unaffected.
Our 30-day goodwill returns policy – standard goods only. In addition to your statutory rights, we offer a 30 calendar-day return period for standard goods, starting on the day you receive them, provided they are: unused and unworn; clean and free from stains, odours or damage; returned in the original packaging with all tags intact. This goodwill policy does not apply to made-to-order or customised goods unless they are faulty.
How to cancel or return. E-mail contact@jmti.co.uk or use the model cancellation form on the Site. Send the goods back within 14 days of telling us you are cancelling or returning. You bear the cost of return postage unless the goods are faulty or mis-described.
Refunds. We refund the price paid (plus the cost of our cheapest standard delivery, where applicable) within 14 days of receiving the goods back, or of you supplying evidence of return—whichever is earlier. Refunds are made to the original payment method.
Diminished value. If goods have been handled beyond what is necessary to establish their nature, characteristics or functioning, we may deduct an amount to reflect any loss in value.
Faulty goods. If a product is faulty, not as described or fails to last a reasonable length of time, you have statutory remedies under the Consumer Rights Act 2015. These rights apply to all goods—standard and made-to-order.
8. Intellectual Property
All text, graphics, logos, photographs, and software on the Site are owned by or licensed to us and protected by copyright, trade-mark and other rights. You may print or download extracts for personal use only. Any other use (including commercial exploitation, modification, distribution or re-posting) requires our prior written consent.
9. Acceptable Use
You must not: use the Site in breach of applicable law; upload or transmit viruses, malware or harmful code; harvest data or conduct automated data collection; submit defamatory, obscene, discriminatory or otherwise unlawful content.
10. Reviews & User Content
When you submit content you grant us a perpetual, worldwide, royalty-free licence to use, reproduce and publish it in connection with the Site and our marketing. We reserve the right (but have no obligation) to remove or edit content that breaches these Terms.
11. Limitation of Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.
Subject to paragraph 11.1, we are not liable for: loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of data or goodwill; indirect or consequential loss. For goods purchased by consumers, our total liability shall not exceed 100 % of the price paid for the relevant goods.
12. Events Outside Our Control
We are not liable for failure to perform, or delay in performing, any obligation where the failure is caused by events outside our reasonable control (“Force Majeure”), including strikes, pandemics, extreme weather, or failure of telecommunications or transport networks.
13. Links to Third-Party Sites
The Site may contain links to external websites. These links are provided for convenience only and we are not responsible for their content or availability.
14. Variations
We may amend these Terms at any time. Updated Terms take effect when posted on the Site and will apply to future orders. You should review them each time you order.
15. Governing Law & Jurisdiction
These Terms and any contract for the purchase of goods are governed by English law. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their home courts.
16. Complaints & Alternative Dispute Resolution
If you have a complaint, please contact us first at contact@jmti.co.uk. If we cannot resolve it, you may use the EU Online Dispute Resolution platform (ec.europa.eu/odr) or another ADR provider, though we are not obliged to participate.
